FAQs
Can I make my own Will or use a kit?
Yes you can. However extreme caution should be exercised. There are all sorts of legal formalities which must be complied with to create a valid Will. If you fail to follow them, your Will may be invalid, it may also inadvertently exclude someone from benefiting who you wish to benefit.
In addition, a Will can be revoked by a subsequent marriage.
If the Will is unclear or ambiguous in any way, this could result in the Will having to be interpreted by the Court which would be costly and time consuming.
The Will may not deal with your assets in the way you intended if you do not draft it correctly.
If we draft your Will, we will consider potential claims against your Estate and ways of protecting your Will and its wishes.
You do not know what you don’t know, which is why it can be risky to draft your own Will and you may not be aware of a better method of achieving your wishes. We have trained and studied the law surrounding Wills and are experts in their drafting. We can also advise on Inheritance Tax and trusts.
If you draft your Will incorrectly, your beneficiaries have no means to obtain any compensation for your error. If we draft your Will incorrectly, your beneficiaries could sue us for professional negligence and we are obliged to have professional indemnity insurance for this purpose.
How long will it take?
The timeframe will be agreed with you before we undertake any work. Generally, you will be provided with a draft Will within 2 weeks of your first meeting with us.
